#TERMS AND CONDITIONS FOR CAR RENTAL


##1. Definitions

**Platform:** Refers to the online platform facilitating bookings between car providers and renters.
**Owner / Provider:** The individual or company listing a vehicle for rent on the platform.
**Renter (Client):** The person making a reservation and renting a vehicle through the platform.
**Vehicle:** The car listed on the platform and rented under these Terms.


##2. Governing Principle

In case of ambiguity, the information displayed on the platform’s website at the time of booking (vehicle details, conditions, included insurance, fees) prevails over these Terms.
Specific conditions mentioned in the vehicle’s listing override general conditions stated here.


##3. Eligibility

Unless otherwise specified in the vehicle listing, the minimum age to rent is 18 years, with at least 1 years of valid driving experience.
A valid driver’s license and ID/passport are required at pick-up.
All EU driving licenses are accepted. Driving licenses from countries that have an agreement with the Albanian government are also accepted. Driving licenses written in English are generally accepted. For all other cases, an international driving permit is required in addition to the original license.
Some vehicle categories may require higher minimum age or additional documents.


##4. Reservation and Payment

Reservations are confirmed upon payment of the advance specified during checkout.
Remaining balance, deposits, and optional extras are settled directly with the Owner/Provider at pick-up.
Prices shown on the website are binding at the time of reservation.


##5. Guarantee and Deposit

**Guarantee:**
At the time of booking, the Renter pays a guarantee amount by card.
This guarantee secures the reservation and protects the Owner/Provider against late cancellations or no-shows.
If the Renter cancels before the free cancellation deadline, the guarantee is refunded to the same card within 2 business days (bank processing may take longer).
If the Renter cancels after the free cancellation deadline or does not show up, the guarantee is transferred to the Owner/Provider to cover economic damage.
If the Renter shows up and proceeds with the rental, the guarantee is refunded back to the same card within 2 business days after successful pick-up (bank processing times may vary).

**Deposit:**
At pick-up, the Renter may be required to leave a refundable deposit with the Owner/Provider, as specified in the vehicle listing.
The deposit is held to cover potential damages, traffic fines, missing fuel, or late returns.
The deposit is refunded after the rental ends, subject to vehicle inspection and deduction of any amounts due.


##6. Insurance

All rentals include at minimum Third-Party Liability (TPL) insurance.
If the Renter is at fault, only the other party is covered.
If the Renter is not at fault, the other party’s insurance covers damages.
Additional insurance packages (for example extended Kasko or full insurance) may be offered by Owners/Providers or third parties and are described in the booking process. The details of what is covered in the insurance package are shown in the “details” link next to the full insurance section in the checkout form.
Exclusions apply to all insurances: damages caused by alcohol, drugs, speeding, negligence, reckless behaviour, or breach of traffic laws are not covered.


##7. Vehicle Availability and Substitution

The Owner/Provider is obliged to provide the Vehicle as described in the listing, with the exact specifications shown (for example transmission type, fuel type, included options).
The Owner/Provider is responsible for ensuring that the Vehicle is in good working condition and has passed technical control.
In case of mechanical or internal defects arising during the rental, responsibility lies with the Owner/Provider, unless the defect is proven to result from the Renter’s misuse, negligence, or breach of these Terms.
If the exact Vehicle is unavailable at pick-up, the Owner/Provider may propose an alternative car. This alternative must be of the same category or higher, with the same specifications, and at the same price. In this case, the Renter cannot cancel the booking.
If the Owner/Provider proposes an alternative car of lower category, then the parties may agree on a discount. If the Renter does not agree with the proposed discount or price, he may cancel the booking and is entitled to a full refund of the prepaid amount.


##8. Vehicle Use

The Vehicle must only be used in compliance with road traffic laws.
The Vehicle may not be used for racing, towing, illegal acts, or by unauthorized drivers.
It is strictly prohibited to drive the Vehicle in unsuitable terrains that are not appropriate for the type of car selected (for example, driving off-road with a non-off-road car).
Violations may result in fines, loss of insurance coverage, and liability for all resulting damages. “If the vehicle is used off-road, it will be seized without warning.”
Cross-border travel is only allowed if explicitly permitted in the car details and may involve additional fees. Border fees are always on client share!


##9. Accidents, Damage, and Reporting

In case of accident or damage, the Renter must immediately inform the Owner/Provider and local police.
A police report must be obtained.
If the police do not respond in time, the Renter must provide evidence that every attempt was made to obtain a police report.
Clear photos of the scene must also be uploaded to the platform.
Failure to provide proper documentation may result in loss of insurance coverage, and the Renter may be fully liable for damages.


##10. Traffic Fines and Violations

The Renter is responsible for all traffic, toll, or parking fines incurred during the rental.
Administrative fees may apply if fines are processed after the rental ends.


##11. Pick-Up and Return

The Renter must inspect the Vehicle at pick-up and report any visible damages using the platform’s upload system.
Photos can be uploaded before and after the rental for transparency and serve as proof of the Vehicle’s condition.
The Vehicle must be returned at the agreed time, date, and place. Late returns may incur extra charges.
The Vehicle must be returned with the same fuel level as at pick-up.


##12. Cancellations and Refunds

Cancellation policies are displayed in the vehicle listing and prevail over these Terms.
In the case of no-shows, the booking is non-refundable.


##13. Platform’s Role and Liability

The Platform acts as an intermediary between Owners and Renters.
Each rental agreement is made directly between the Owner and the Renter.
The Platform is not responsible for disputes, accidents, damages, or fines, except where required by law.


##14. Termination of Rental

The Owner/Provider may terminate the rental without refund if the Renter breaches these Terms (for example unauthorized use, reckless driving, false documents).
The Vehicle must then be returned immediately.


##15. Governing Law and Jurisdiction

These Terms are governed by the laws of Albania.
Disputes will be settled by the courts of Albania, unless otherwise required by law
